These Terms and Conditions ("the Terms and Conditions") govern your ("the User") use of the Dive Action (”the Provider") website located at the domain name www.diveaction.co.za ("the Website"). By accessing and using the Website, the User agrees to be bound by the Terms and Conditions set out in this legal notice. The User may not access, display, use, download, and/or otherwise copy or distribute content obtained on the website for marketing and other purposes without the consent of the Provider.

Detailed Description of Good and / or Services
Dive Action CC (T/A Dive Action) is a business in the Southern African Dive industry that sells Diving Equipment, Diving Related Products, Underwater Photographic Equipment and Diving Training online.

Delivery Policy
Orders are processed Monday to Friday, excluding public holidays. Orders are not delivered on the weekends or public holidays.

We strongly suggest that you request shipping your order to a business address. We do not ship to postal addresses or multiple addresses per order.

If a product is in stock and is not a special order item, we’ll dispatch your order within 1 working day provided there are no problems with authorising your payment and you placed your order before 12h00.

If a product is not in stock in our warehouse, or is a special order item, then we are unable to confirm an expected delivery time or date and this will be provided only after the transaction.

Refunds and Returns
Items purchased from Dive Action (with the exception of special order items) may be canceled, exchanged or returned provided these items are returned unused, in original packaging and in pristine condition within the stipulated time period.
You are entitled to cancel without reason and without penalty any transaction of goods purchased from Dive Action within seven (7) working days after the date of the receipt of the goods.- are these two mutually inclusive - don’t both sentences say the same thing - do we need the second one - can we include the 7 days in the first one?

Credit card payments will be refunded to the card used to make the purchase and purchases made by direct transfer will be refunded to the account of origin. Refunds will be made within thirty (30) days of the date of receipt of cancellation. - should we be quicker than that? Costs and arrangement for returning cancelled goods are for the customers account (unless goods have not been dispatched and/or we have delivered an item to you in error or an item that is damaged).

Customer Privacy Policy
Dive Action shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, "personal information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). The PAIA may be downloaded from:

Payment Options Accepted
Payment may be made via Visa or Master Card credit cards or by bank transfer into the Dive Action bank account, the details of which will be provided on request.

Credit Card Acquiring and Security
Credit card transactions will be acquired for Dive Action by PayFast. PayFast uses SSL3 and credit card information is stored per Visa and Mastercard guidelines on the website. Users may go to www.payfast.co.za to view their security certificate and security policy.

Customer Details Separate from Card Details
Customer details will be stored by Dive Action separately from card details which are entered by the client on the PayFast secure site. For more detail on PayFast refer to www.payfast.co.za

Merchant Outlet Country and Transaction Currency
The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction Currency is ZAR (South African Rand).

Responsibility
Dive Action takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer services and support, dispute resolution and delivery of goods.

Country of Domicile
This website is governed by the laws of South Africa and Dive Action chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature, 22 Carlisle Street, Paarden Eiland, 7405.

Variation
Dive Action may, in its sole discretion, change this agreement or any part thereof at any time without notice.

Export Restriction
The offering on this website is available to South African and Sub-Saharan African customers only.
